ProMock Website Terms of Use and Conditions of Order Agreement (“Agreement”) is made by and between ProMock and ProThoughts Solution, parent company, (“ProMock,” “us,” “we” and “our”) and you (“you,” “your,” or “user”). This Agreement sets forth the terms and conditions that apply to your use of any website that displays, links to, or refers to this Agreement.

BY ACCESSING, VISITING, BROWSING, USING, OR ATTEMPTING TO INTERACT WITH ANY PART OF THIS WEBSITE, INCLUDING WITHOUT LIMITATION THE WEBSITE’S FORMS OR ONLINE STORE (COLLECTIVELY “SERVICES”), YOU AGREE, ON YOUR BEHALF PERSONALLY, AND ON BEHALF OF ANY ENTITY FOR WHICH YOU ARE AN AGENT OR YOU APPEAR TO REPRESENT, THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, DO NOT ACCESS OR USE ANY PART OF THIS WEBSITE. PROMOCK RESERVES THE RIGHT, FROM TIME TO TIME, WITH OR WITHOUT NOTICE TO YOU, TO MAKE CHANGES TO THIS AGREEMENT IN PROMOCK SOLE DISCRETION. CONTINUED USE OF ANY PART OF THIS WEBSITE CONSTITUTES YOUR ACCEPTANCE OF SUCH CHANGES. THE MOST CURRENT VERSION OF THIS AGREEMENT, WHICH SUPERSEDES ALL PREVIOUS VERSIONS, CAN BE REVIEWED BY CLICKING ON THE “TERMS OF USE” HYPERLINK LOCATED ON THE PROMOCK WEBSITE.

General Terms and Condition 

  1. ACCESS TO THIS SITE

You may be asked to give certain registration details or other information, such as your name, e-mail address, and other credentials, in order to access this website or some of the tools it provides, including ProMock. All information you give on this website must be correct, current, and complete as a condition of your use of this website. If ProMock believes the information you provide is not correct, current, or complete, ProMock has the right to refuse you access to this website or any of its resources and suspend your access to its simulator.

2. RESTRICTIONS ON USE

As a condition of your use of ProMock’s website, you warrant to ProMock that you will not use the website for any purpose that is unlawful or prohibited by any part of this Agreement. For example, you may not co-brand this website on any other platform without written permission of an authorized representative of ProMock. For the purposes of this Agreement, “co-branding” means displaying a name, logo, trademark, or other means of attribution or identification of any party in such a way that a user is reasonably likely to believe that such other party has the right to display, publish, or distribute this website or content accessible through this website. You agree to cooperate with ProMock in causing any unauthorized co-branding or framing immediately to cease. 

Furthermore, you may not use ProMock’s website in any way that could disable, overburden, damage, or impair the website, or interfere with the use and enjoyment of the website by any other person. You may not access or attempt to obtain any materials, content, or information from the website by any methods not expressly made available or provided for on the website. You are only permitted to use the website for personal, non-commercial purposes.

3.PROPRIETARY INFORMATION

The material and content accessible from this website, and any other website owned, operated, licensed, or otherwise controlled by ProMock, including without limitation any text, photos, videos, audio, scripts, software, markup language, or other content whether perceptible or not to a human (whether displayed, downloadable or otherwise) (the “Content”) is the proprietary information of ProMock or the party that provided or licensed the Content to ProMock, whereby such providing party retains all right, title, and interest in the Content. Accordingly, the Content may not be copied, republished or transmitted in any way without the prior written consent of ProMock. 

4. HYPERLINKS

This website may be hyper-linked to other websites which are not maintained by, or related to, ProMock and may contain information about products or services that are not related to or endorsed by ProMock. Hyper-links to such websites and information are provided as a service to you and are not sponsored by or affiliated with this website or ProMock. ProMock may not have reviewed any or all of such websites and information and is not responsible for the content of those websites or the descriptions of their products and services. ProMock is not responsible for webcasting or any other form of transmission received from any hyperlinked website. Hyper-links are to be accessed at your own risk and information contained therein is relied upon at your own risk. 

5. SUBMISSIONS

You hereby grant to ProMock a royalty-free, perpetual, irrevocable, worldwide, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, make, use, sell, offer to sell and import all content, remarks, inventions, suggestions, ideas, graphics, or other information communicated to ProMock by you through this website (together, the “Submission”).You further agree that ProMock may use your name, likeness, pseudonym, avatar, or other information related to your identity and provide it to ProMock through the website in conjunction and with your Submission. ProMock will not be required to treat any Submission as confidential and may use any Submission in its business (including without limitation, for products or advertising) without incurring any liability for royalties or any other consideration of any kind and will not incur any liability as a result of any similarities that may appear in future ProMock operations.

DISCLAIMERS 

You understand that ProMock cannot and does not guarantee or warrant that the website or its Content, or any other files available for downloading from the Internet will be free of viruses. ProMock does not assume any responsibility or risk for your use of the website, its Content, or the Internet. The Content is not guaranteed to be complete or current, and it should not be used to replace any written reports, statements, or notices issued by ProMock.

General Terms and Conditions Apply to ProMock Exam Simulator

All terms and conditions stated above “General Terms and Conditions” also apply to Exam Simulator without exception. 

Product Access 

Access to The ProMock Exam Simulator is granted on a time-limited basis. The initial access period (i.e., initial 120-day access) begins the day you start the simulator’s first exam or quiz. To activate the exam subscription, you have one (1) year from the date of purchase. If you do not activate your exam subscription within one (1) year, the system will do it for you, and your access will be terminated 120 days afterwards.

Example: 

On July 14, 2021, you purchase the exam simulator but do not activate it.

Your simulator will be enabled automatically on July 15, 2022.

Your access ends 120 days thereafter the system will send you several notifications about the 1-year activation period (i.e., “You have 6 months left to activate”).

The ProMock Exam Simulator cannot be downloaded. The ProMock Exam Simulator is most preferred for use on a desktop or laptop computer only.

(A.) No Exam Passing Guarantee 

You agree that a passing score in an exam or quiz of The ProMock Exam Simulator is no guarantee that you will pass the PMP Exam.

(B.) Refund Policy

We do not have a refund policy for Pro-Mock platform. Once the free trial ends and the service is purchased, there is no refund processed under any other circumstances.

 (C.) Once the exam ends its period, e.g. The 120-day access ends, all the user data will be deleted and the user has to re-purchase if he / she wishes to take the exam again. The data cannot be retrieved after the access period is over.
